CHAPTER ONE
MARITIME TRANSPORT AND THE MARITIME INDUSTRIES
1. Categories
Maritime transport can be categorized on the basis of two criteria: service and distance. The first covers bulk shipping and liner shipping for cargo, and passenger ferries and cruise ships for carrying passengers; the second covers deep sea and short sea shipping.
The different types of transport are distinct from one another. Bulk transport is generally organized within a free market and is labour-intensive rather than capital-intensive. Liner shipping, on the other hand, is organized in conferences, which for the most part are cartels that control the rates and market share of a specific liner shipping company or group of companies. In terms of production factors, liner shipping is highly capital-intensive in both tonnage and land-based infrastructures.

The CII Operations Clause for Time Charter Parties is now available to download free of charge from our website.
The BIMCO Documentary Committee has adopted the CII Operations Clause for Time Charter Parties which will help the industry commercially navigate the complexities of the new CII regulations from the International Maritime Organization (IMO).
The new regulations on the carbon intensity of international shipping will come into force on 1 January 2023.
Owners and charterers need to collaborate and cooperate to manage the IMO objective to reduce carbon emissions. The clause sets out a way forward in a time charter context, where the charterers are responsible for the operation of the vessel.

The former captain of the migrant rescue vessel ‘Sea-Watch 3’, Carola Rackete, has recently been cleared of all charges regarding the 2019 dispute over port access in Italy. Throughout the years, Rackete has been often criticized by the former Italian Minister of the Interior Matteo Salvini and other European right-wing leaders, who used her as a scapegoat to criminalize migration. It is thus important to look back at this case in order to further analyze the event and shed light on the controversies that have arisen from it.
