La Sección Tercera de la Audiencia Provincial de Málaga ha estimado el recurso de apelación interpuesto por el PSOE y ha ordenado reabrir la investigación judicial sobre los presuntos delitos de prevaricación y malversación cometidos presuntamente en el seno del Puerto Deportivo de Benalmádena, empresa municipal de capital íntegramente público.
La decisión llega después de que un juzgado de Torremolinos archivara el caso el año pasado sin investigarlo a fondo, algo que ahora la Audiencia Provincial ha considerado incorrecto.
El caso arranca en noviembre de 2023, cuando José Luis Bergillos, consejero delegado del Puerto Deportivo — y concejal del Partido Popular en el Ayuntamiento— habría firmado un acuerdo privado con varios propietarios de embarcaciones turísticas conocidas como chárters. Según

According to The Moscow Times and vessel tracking data from MarineTraffic and VesselFinder cited on April 25, the 142-meter yacht Nord departed Dubai on April 24 and transited the Strait of Hormuz overnight, heading toward Oman.
The same data indicated that several other vessels—including two tankers under US sanctions, five cargo ships, and a passenger ferry—also crossed the strait during that period.
